ASOR Mobile Application

Welcome to the ASOR mobile application (the “Application”), owned and operated by ASOCIAȚIA ORAȘ REGAL SINAIA (“ASOR”), a Romanian non-profit legal entity headquartered in Sinaia, Romania.

By downloading, installing, accessing, or using the Application, you confirm that you have read, understood, and fully accepted these Terms and Conditions (“Terms”). If you do not agree, please do not use the Application.

1. Purpose of the Application

The Application has an informational, educational, and community purpose and provides users with access to:

  • information regarding tourist, cultural, and commercial attractions in Sinaia;
  • virtual tours and multimedia content;
  • local events;
  • interactive functionalities;
  • the possibility to make donations and access products/services through external web pages;
  • functionalities dedicated to the management of the ASOR community and the Association’s volunteers, including communication, organization, and involvement in activities.

The Application does not constitute a tourism service within the meaning of legislation governing package travel services.

2. Eligibility and Acceptance of the Terms

Use of the Application is permitted only to individuals who:

  • are at least 18 years old or use the Application under the supervision of a parent/legal guardian;
  • have full legal capacity to enter into legal agreements.

ASOR reserves the right to restrict access to any user who violates these Terms.

3. Access and Use of the Application

The Application is available free of charge through the official platforms:

  • Google Play (Android)
  • App Store (iOS)

ASOR grants the user a limited, non-exclusive, non-transferable, and revocable right to use the Application.

The following are strictly prohibited:

  • using the Application for illegal, fraudulent purposes or in violation of applicable laws;
  • copying, reproducing, downloading, saving, archiving, extracting, recording, distributing, publishing, transmitting, commercializing, sublicensing, or making available to third parties the Application or any part thereof without ASOR’s/the rights holder’s prior written consent;
  • copying, reproducing, capturing, taking, modifying, adapting, translating, decompiling, or using in any form the content of the Application, including without limitation texts, images, graphic elements, design, interface, structure, visual appearance, format, databases, logos, audio-video materials, source code, or other protected elements;
  • using any automated or manual methods to extract, copy, collect, or reproduce content, including through scraping, crawling, systematic screenshots, mass copying, automated software tools, bots, scripts, or any other similar technologies;
  • removing, concealing, or modifying notices regarding copyright, trademarks, intellectual property rights, or other legal notices;
  • performing reverse engineering, decompilation, disassembly, or attempting to identify the source code, algorithms, or operating mechanisms of the Application, to the extent permitted by law;
  • unauthorized access to systems, servers, databases, or infrastructure associated with the Application;
  • abusive use or carrying out actions that may affect the functioning, security, availability, performance, or integrity of the Application.

Violation of these prohibitions may result in suspension or termination of access to the Application, as well as civil, administrative, or criminal liability, as applicable under relevant legislation.

4. User Account

To access certain functionalities, the user may create an account.

The user:

  • is responsible for the accuracy of the data provided;
  • is responsible for account security;
  • must immediately notify ASOR in the event of unauthorized use.

ASOR reserves the right to suspend or delete accounts that violate these Terms.

The user has the right to delete their account at any time, directly from the Application through the dedicated functionality (“Delete Account”).

Account deletion:

  • results in deactivation of access to services associated with the account;
  • involves deletion or anonymization of personal data, except for data that must be retained in accordance with legal obligations;
  • is, in principle, irreversible.

ASOR may retain certain data:

  • to comply with legal obligations;
  • for fraud prevention purposes;
  • for the defense of rights before courts.

5. Personal Data (GDPR)

Personal data are processed in accordance with:

  • Regulation (EU) 2016/679 (“GDPR”);
  • applicable national legislation.

Types of data collected:

  • name;
  • email address;
  • location data (with consent);
  • other data necessary for the functioning of the Application.

Purposes:

  • providing services;
  • account administration;
  • relevant communications;
  • improving the Application.

The user’s rights include:

  • right of access;
  • rectification;
  • erasure (“right to be forgotten”);
  • restriction of processing;
  • objection;
  • data portability.

6. Donations and Payments

Donations and purchases are processed through the official website:

www.asor.ro, accessible in the Application through a secure webview.

Clarifications:

  • payments are processed by authorized third parties;
  • ASOR does not store bank card information;
  • any transaction is subject to the terms of the payment processor.

Donations are voluntary and, in principle, non-refundable, except where otherwise provided by law.

7. User-Generated Content

Users may publish reviews and ratings.

By publishing content, the user:

  • warrants that they have rights over the content;
  • grants ASOR a non-exclusive right to use such content.

ASOR may:

  • moderate, edit, or delete content;
  • remove offensive, illegal, or inappropriate content.

8. Location and GPS Services

The Application may access the user’s location only with the user’s consent.

Location data:

  • are used exclusively for map functionality;
  • are not permanently stored;
  • may be disabled through the device settings.

9. Intellectual Property

All rights relating to the Application belong to ASOR or its licensors.

The following are strictly prohibited:

  • copying;
  • reproduction;
  • distribution;
  • modification of content.

10. External Content and Third Parties

The Application may include links to third-party websites or services.

ASOR:

  • does not control such services;
  • is not responsible for their content or policies.

Their use is undertaken at the user’s own risk.

11. Partners and Third-Party Services

The Application may include information about partners (restaurants, hotels, merchants, service providers, or other entities).

By using the Application, the user understands and accepts that:

  • Partners are independent entities that operate under their own responsibility;
  • ASOR is not the provider of products or services offered by such partners;
  • ASOR does not guarantee the quality, availability, safety, or compliance of products or services offered;
  • Any contractual relationship is established directly between the user and the partner.

ASOR cannot be held liable for:

  • non-performance or defective performance of services;
  • non-conforming products;
  • any damages resulting from interactions with partners.

12. Discounts and Benefits

The Application may display discounts, offers, or benefits provided by partners.

These:

  • are granted exclusively based on partnerships between ASOR and partners;
  • may be subject to limitations (period, availability, stock, special conditions);
  • may be modified or withdrawn without prior notice.

ASOR:

  • does not guarantee the availability of benefits;
  • is not responsible for a partner’s refusal to grant benefits;
  • does not guarantee the permanent accuracy of information relating to offers.

13. Events

The Application may display information regarding local events.

The user understands that:

  • most events are organized by third parties (independent organizers);
  • information regarding events consists of public data collected from sources considered relevant.

ASOR:

  • is not the organizer of such events (except for those explicitly identified in the Application);
  • does not guarantee the accuracy, updating, or actual occurrence of events;
  • is not responsible for modifications, cancellations, or any incidents.

Events organized directly by ASOR will be distinctly marked in the Application.

14. Limitation of Liability

To the fullest extent permitted by law:

  • the Application is provided “as is” and “as available”;
  • ASOR does not guarantee uninterrupted operation or absence of errors.

ASOR shall not be liable for:

  • indirect or consequential losses;
  • loss of data;
  • decisions made based on information contained within the Application.

ASOR is not responsible for:

  • partner activities;
  • quality of services provided by third parties;
  • information supplied by event organizers;
  • availability of offers or discounts.

15. Termination of Use

ASOR may suspend or terminate the user’s access:

  • in case of violation of these Terms;
  • for technical or security reasons.

The user may stop using the Application at any time by uninstalling it.

16. Modification of the Terms

ASOR may modify these Terms at any time.

The updated version:

  • will be published in the Application and on the website;
  • enters into force on the date of publication.

Continued use constitutes acceptance of the modifications.

17. Governing Law and Jurisdiction

These Terms are governed by Romanian law.

Any dispute shall be resolved by the competent courts of Romania, unless otherwise provided by law.
